10. Bottom line, how can we protect ourselves from these predatory
proceedings as we age?
Bottom line, it is my belief that these so-called "protective
proceedings" should never be used to control any adult of any age whose
decision-making capacity is intact. In chapter eight in THE RETIREMENT
NIGHTMARE, I suggest 14 keys ways in which the laws should be changed.
Unfortunately, I assume that such changes will come too slowly--if at all.
The answer to this question, then, is the focus of the last chapter
in THE RETIREMENT NIGHTMARE. There are five steps you can take to protect
yourself from an involuntary (unwanted) conservatorship or guardianship
during your golden years. The steps discussed in the book are:
1. Working with the right attorney
a. How do I find a good attorney?
b. What should I ask him or her?
2. For property management
a. Durable powers of attorney
b. Revocable trusts
c. Durable powers of attorney in conjunction with
revocable living trusts
d. "Convenience" joint tenancy accounts
3. For healthcare decisions
a. Durable powers of attorney for healthcare decisions
b. Living wills
4. Preselecting a conservator or guardian
5. Preventing future challenges to your legal directives
